The Chicago Soccer Foundation Queen of Hearts Raffle ("Raffle")
OFFICIAL RULES: By participating, entrants agree to be bound by these Official Rules and by the decisions of Chicago Soccer Foundation, which shall be binding and final as to all matters related to each Raffle. Official Rules are posted online at www.chicagosoccerfoundation.org The Official Rules should be read before ticket purchase.
SPONSOR: The sponsor of the Raffle is Chicago Soccer Foundation, a 501(c)(3) non-profit charitable organization.
RAFFLE PERIOD; HOW TO ENTER: Chicago Soccer Foundation will conduct the Raffle from December 13, 2020 until a participant draws the Queen of Hearts from a virtual envelope pursuant to the drawing procedures set forth below (“Raffle Period”). The Raffle Period may last up to fifty-four (54) weeks. During the Raffle Period, Raffle tickets will be sold online as follows:
Visit www.chicagosoccerfoundation.com (the "Website") and follow the directions to purchase a Raffle Ticket. Internet sales of Raffle tickets are open ONLY TO LEGAL RESIDENTS OF ILLINOIS PHYSICALLY PRESENT IN ILLINOIS WHEN THE TRANSACTION OCCURS. This Raffle is VOID OUTSIDE ILLINOIS AND WHEREVER PROHIBITED BY LAW. Entrants purchasing Raffle Tickets online must fully complete their purchase using the procedures specified. All online ticket purchase requests are subject to verification by Chicago Soccer Foundation, and no sale is final until the ticket purchase order is accepted by Chicago Soccer Foundation in Chicago, Illinois
Ticket sales for the first Weekly Drawing (defined below) will begin at the commencement of the Raffle Period. Ticket sales for subsequent Weekly Drawings, if any, will begin at or around 7:30 p.m. Central Time following the prior week’s Weekly Drawing. Ticket sales for each Weekly Drawing will conclude at or around 6:00 p.m. Central Time on each Friday during the Raffle Period. Entries not selected in a Weekly Drawing will not carry over into subsequent Weekly Drawings, if any.
ELIGIBILITY TO ENTER: While available, Raffle tickets may be purchased only by persons 18 years or older in accordance with these Official Rules.
The following persons are NOT ELIGIBLE to participate in the Raffle or to win any
prize: Employees, officers, directors, shareholders and board members of Chicago City Soccer Club, Chicago Rec Sports, and employees, officers, directors, shareholders and board members of Chicago Soccer Foundation who are involved in the administration of the Raffle or any Raffle drawing (each an "Ineligible Party"), and their Immediate Family Members (as defined below) and members of their same household (whether legally related or not). "Immediate family members" means a spouse, parent, legal guardian, grandparent, sibling, child and grandchild of an Ineligible Party.
PURCHASING RAFFLE TICKETS: Raffle tickets will be sold in packages as described below. There is no limit to the number of Raffle tickets an eligible individual may purchase.
One (1) Raffle Ticket for $5.00
Five (5) Raffle tickets for $10.00
Twenty (20) Raffle Tickets for $20.00
Raffle tickets may be given out through social media engagement prizes. These will be limited to one (1) per account. Eligibility Requirements must be met. Raffle tickets will be available for purchase online by eligible persons (see "ELIGIBILITY TO ENTER" above).
At the time of purchase, each entrant will select a single virtual envelope number from the remaining unopened virtual envelopes. This envelope number will be associated with all tickets purchased in the ticket package. It is not possible to select multiple envelope numbers within a single ticket order.
Each envelope corresponds to a single hidden playing card from a standard card deck. The initial number of envelopes available for selection is 54, and the number of envelopes available for selection will decline by one each week if the envelope selected by the weekly drawing winner reveals a playing card other than the Queen of Hearts.
A confirmation email will be sent from our LeagueApps site. It is the responsibility of the ticket purchaser to ensure that he or she receives his or her purchase confirmation. Purchasers do not need to have their tickets in hand to win. In the event a purchaser does not receive his or her purchase confirmation, such purchaser should contact Chicago Soccer Foundation at email@example.com.
NUMBER OF RAFFLE TICKETS: There is no minimum and no maximum number of tickets that must be sold.
ODDS: The odds of winning a prize depends on the number of valid tickets sold during the week preceding the Weekly Drawing.
WEEKLY DRAWINGS: Each Sunday during the Raffle Period, at approximately 6:00 p.m. Central Time, a single ticket number will be selected by random number generation from all tickets sold since the prior week’s Weekly Drawing. The drawing will be conducted electronically at the Chicago City HQ, 1414 W Irving Park Rd. Entrants need not be present at the Weekly Drawing to win.
Each Weekly Drawing winner will receive, subject to verification and the terms and conditions set forth below, five (5) free tickets into the next week’s drawing. The playing card corresponding to the virtual envelope number associated with the Weekly Drawing winner’s winning ticket will be revealed. Depending on the card revealed, one of the following two (2) scenarios will take place:
A. If the playing card revealed is the Queen of Hearts, such Weekly Drawing winner will be, subject to verification and the terms and conditions set forth below, deemed the grand prize winner, and will receive a cash prize equal to fifty percent (50%) of the net Raffle ticket sales revenue generated over the entire Raffle Period (“Grand Prize”). Net Raffle ticket sales revenue shall be as determined by Chicago Soccer Foundation in its sole discretion, and is calculated as gross ticket sales revenue (for the entire Raffle Period) less reasonable sums expended for prizes, local license fees and other reasonable operating expenses incurred as a result of operating the Raffle. After the award of the Grand Prize, the Raffle will be deemed concluded.
B. If the playing card revealed is a card other than the Queen of Hearts, the Weekly Drawing winner will receive only the weekly drawing prize referenced above and no additional prize. All previously sold tickets shall be deemed void, and ticket sales for the next week’s Weekly Drawing will commence. The virtual envelope number associated with the Weekly Drawing winner’s winning ticket shall no longer be available for the remainder of the Raffle Period.
All net proceeds of the Raffle will benefit Chicago Soccer Foundation and the programs and charitable donations that Chicago Soccer Foundation supports.
Chicago Soccer Foundation will use reasonable efforts, in its sole discretion, to notify prize winners of their selection using the contact information provided with ticket purchase, and will post the winning ticket number online at www.chicagosoccerfoundation.org. Chicago Soccer Foundation will also post the playing card revealed after the conclusion of the Weekly Drawing. Chicago Soccer Foundation is not responsible for any unsuccessful attempt to notify a winner. Each winner must claim their prize within seven (7) days of selection, or the prize will be forfeited. Winners are responsible for claiming prize within the time frame regardless of whether the winner received notification from Chicago Soccer Foundation. No alternate winners will be selected, and any unclaimed prizes will be forfeited to Chicago Soccer Foundation and not awarded.
Subject to the terms and conditions of these Official Rules, the Grand Prize winner will receive a check in the amount of the prize, net of any withholding or other taxes or assessments required or permitted to be withheld by the Chicago Soccer Foundation under applicable federal, state or local laws, rules or regulations, that will be mailed within forty-five (45) days after the date of the Grand Prize winner’s selection, after the Chicago Soccer Foundation has verified the winning Raffle ticket and prize winner has satisfied all terms and conditions of these Official Rules, including return of all forms and documents to Chicago Soccer Foundation (Chicago Soccer Foundation may be required to withhold federal taxes in accordance with IRS regulations, and will do so as a pre-condition of Grand Prize winner receiving prize money). If applicable, prize winner will be issued an IRS Form 1099 or IRS Form W2-G for the amount of the prize. No substitution, assignment, refund or transfer of a prize is permitted, except by the Chicago Soccer Foundation in its sole discretion.
TRANSFER OF RAFFLE ENTRIES: Raffle tickets may not be transferred. All Raffle tickets which have been resold or transferred in violation of these Official Rules shall be void. All individuals who re-sell or transfer Raffle tickets in violation of these Official Rules shall be ineligible to participate in the Raffle or to win a prize.
DETERMINATION OF OFFICIAL WINNER(S): Chicago Soccer Foundation shall have the sole discretion to determine whether a Potential Winner is an official winner of a prize (an "Official Winner"). Chicago Soccer Foundation's decision concerning the identity of Official Winners shall be final and binding. To become an Official Winner: (1) the Potential Winner must be eligible to participate in the Raffle under these Official Rules and must not be in violation of these Official Rules as determined in Chicago Soccer Foundation's sole judgment; (2) the Potential Winner's identity as the purchaser of the winning ticket must be verified as specified below; (3) the Potential Winner must execute and return to Chicago Soccer Foundation an affidavit of eligibility and liability/publicity release on a form to be provided by Chicago Soccer Foundation before the prize is awarded; and (4) the Potential Winner must provide Chicago Soccer Foundation with all tax identification information required by federal, state or local law and, where applicable, provide Chicago Soccer Foundation with payment for any required withholding taxes due prior to that Potential Winner's receipt of a prize. If for any reason whatsoever all of the foregoing requirements are not satisfied with respect to a particular Potential Winner, or if Chicago Soccer Foundation is unable for any reason to identify the holder of a winning Raffle Ticket, then the Potential Winner's prize will be deemed forfeited. Any ticket that the Chicago Soccer Foundation determines, in its sole judgment, was stolen, unissued, ineligible, altered counterfeit in whole or in part, defective, printed in duplicate or printed/produced in error will be void.
Chicago Soccer Foundation shall use the following rules to determine the identity of any Potential Winner and of the Official Winner of any prize: the owner of such winning Raffle ticket shall be the individual whose credit card information was used to purchase the ticket. Such individual’s identity is subject to verification by Chicago Soccer Foundation. In the unlikely event that an error or problem in the administration of the Raffle results in two (2) or more Raffle ticket purchasers holding winning Raffle tickets that contain identical ticket numbers, then the person who has record of the earliest ticket purchase shall be deemed to hold the winning ticket.
GENERAL CONDITIONS: The Released Parties (defined below under "RELEASE OF LIABILITY") are not responsible for: (1) tickets which are stolen, lost, damaged, illegible, given away or no longer in the purchaser's possession, (2) tickets that have been or may have been tampered with or re-sold in violation of these Official Rules; (3) tickets or payments that are delayed, misdirected, undelivered, not fully captured, or garbled; (4) any other errors of any kind, whether human, typographical, printing, mechanical, or electronic in nature, which relate to or are connected with the Raffle (collectively, as described in clauses (1) through (4), "Errors"), including without limitation Errors in Raffle-related materials or in the administration of the Raffle, such as Errors in processing tickets, identifying Potential Winners, determining the Official Winners, or announcing or delivering a prize. In addition, the Released Parties are not responsible if any portion of the Raffle is compromised, in Chicago Soccer Foundation's sole judgment, by non-authorized activity or other causes which, in Chicago Soccer Foundation's sole judgment, corrupt or impair the administration, security or fairness of the Raffle, or the proper submission or capture of tickets (collectively, a "Compromising Event"). In the event of a Compromising Event, Chicago Soccer Foundation reserves the right, in its sole discretion, to suspend, modify or terminate the Raffle. If the Raffle is not terminated, Chicago Soccer Foundation reserves the right to select winners from all eligible, non-suspect tickets received before the known occurrence or discovery of such Comprising Event. All ticket purchases shall be final, and no refunds or replacements will be issued by Chicago Soccer Foundation. Chicago Soccer Foundation reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the Raffle process or the operation of the Raffle or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of this Raffle is a violation of criminal and civil laws, and, should such an attempt be made, Chicago Soccer Foundation reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Chicago Soccer Foundation's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules. Chicago Soccer Foundation has sole and final decision on admissibility of entries and the determination of Official Winners.
RELEASE OF LIABILITY: By entering, each entrant agrees to abide and be bound to these Official Rules, and to release, indemnify and hold harmless:
Chicago City Soccer Club, Chicago Rec Sports LLC., Chicago Soccer Foundation and each of their respective directors, officers, owners, shareholders, subsidiaries, members, partners, agents, representatives, employees, successors, parents, heirs, executors, administrators and affiliates (individually a "Released Party" and collectively, the "Released Parties") from and against any and all liability, claims, losses, damages or causes of action of any kind (however named or described) with respect to or arising out of (i) entrant's participation in the Raffle or winning any prize, or (ii) entrant's acceptance, possession, misuse or use of any prize or participation in this Raffle or any Raffle related activity. In addition, each Winner agrees to release, indemnify and hold the Released Parties harmless from any and all losses, damages, rights, claims and actions of any kind rising in connection with or as a result of participating in the Raffle or the Winner's acceptance or use of any prize.
LIMITATION OF LIABILITY: A Raffle entrant's sole and exclusive remedy for any Released Party's breach of duty or conduct related to the Raffle shall be limited to the return of the purchase price paid for his or her Raffle ticket(s). In no event shall any Released Party be liable to any person for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, arising out of the Raffle.
PUBLICITY RELEASE: Each Official Winner, by accepting his or her prize, grants Chicago Soccer Foundation and Chicago Soccer Foundation's designees and affiliates, including Chicago City Soccer Club, and Chicago Rec Sports, full permission, except where legally prohibited, to use that Official Winner's first and last name, address (city and state only), photograph, statements, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity.
TRADEMARKS: All trademarks are the property of their respective owners, and may not be used except with express written consent of the trademark owners.
DISPUTES; SEVERABILITY: Each Raffle participant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Raffle, or any prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in Chicago, Illinois, and each Raffle participant submits to sole and exclusive personal jurisdiction of said courts in the State of Illinois for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred to purchase the Raffle Tickets, but in no event attorneys' fees; and (c) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs to purchase the Raffle tickets, and entrant waives any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants or Chicago Soccer Foundation in connection with the Raffle shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Illinois, the United States, or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of Illinois. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular persons or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules, and the application of all of these Official Rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law.
